estate assets are those, which by their nature are fixed in space and cannot be moved, as buildings, farms, land, premises, plots, garages, commercial premises, etc. And all of them should be registered in the Property Registry, in order to guarantee their owner the enjoyment of the rights derived from their possession.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Rights_derived_from_the_possession_of_a_real_estate\"><\/span>Rights derived from the possession of a real estate<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>The owner of any of a real estate or properties mentioned above has the following rights:<\/p>\n<ul>\n<li><strong>Right of use<\/strong>: you can occupy or use the property whenever you want.<\/li>\n<li><strong>Right for the development of activities<\/strong>: the owner can use the property for the development of private or business activities allowed by law.<\/li>\n<li><strong>Right of lease:<\/strong> you can also rent said property to earn income.<\/li>\n<li><strong>Right of assignment<\/strong>: the owner has the right to donate or assign the real estate, either temporarily or permanently.<\/li>\n<\/ul>\n<p><a class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Spanish Civil Code also establishes a <strong>classification of real estate<\/strong>, based on four criteria: by nature, by destination, by incorporation and by analogy.<\/p>\n<ul>\n<li><strong>By nature: <\/strong>refers to land, buildings, roads and constructions attached to the ground.<\/li>\n<li><strong>By incorporation: <\/strong>real estate are considered to be those assets attached to \u00a0ground as well as any other attached to the property in such a way that they cannot be separated from it without causing damage to the property or the element itself<\/li>\n<li><strong>By destination<\/strong>: assets belonging to the owner of the property, as well as its annexes, which serve and are necessary to carry out the work or exploitation activities carried out in the latter.<\/li>\n<li><strong>By analogy<\/strong>: It refers to administrative concessions of public works, easements and other real rights over real estate.<\/li>\n<\/ul>\n<p>However, <strong>real estate law does not address all of them<\/strong>, but only real estate by nature and incorporation, and some real estate by analogy, such as administrative concessions for public works.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Legal_framework_of_real_estate_law\"><\/span>Legal framework of real estate law<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Real estate law is composed of rules <strong>including different legal bodies <\/strong><\/p>\n<p>On the one hand, its legal framework is established in the <a href=\"https:\/\/translate.google.com\/translate?hl=es&amp;prev=_t&amp;sl=es&amp;tl=en&amp;u=https:\/\/www.boe.es\/buscar\/act.php%3Fid%3DBOE-A-1978-31229\">Spanish Constitution<\/a>, it includes the right to property.<\/p>\n<p>On the other hand, the Civil Code and regional laws contain rules relating to contracts that regulate the transfer of property (sale, deposit, exchange, purchase option, inheritances, donations, etc.); the constitution and transfer of charges (mortgages, censuses, easements, usufructs); and the leasing of real estate.<\/p>\n<p>Finally, there are other rules that regulate specific aspects related to real estate law, such as: tax laws, mortgage law, the Building Planning Law, the Urban Leasing Law, or the Real Estate Cadastre Law, among
