{"id":6499,"date":"2023-05-02T20:08:16","date_gmt":"2023-05-02T18:08:16","guid":{"rendered":"https:\/\/vbbabogados.com\/?p=6499"},"modified":"2023-05-02T20:27:38","modified_gmt":"2023-05-02T18:27:38","slug":"la-condicio-resolutoria-en-la-compra-dun-immoble","status":"publish","type":"post","link":"https:\/\/vbbabogados.com\/ca\/blog\/la-condicio-resolutoria-en-la-compra-dun-immoble\/","title":{"rendered":"La condici\u00f3 resolutoria en la compra d&#8217;un immoble"},"content":{"rendered":"<p>La condici\u00f3 resolut\u00f2ria \u00e9s una garantia de pagament quan en la compravenda s&#8217;acorda que el preu es pagar\u00e0 de forma ajornada i el venedor el que pret\u00e9n \u00e9s assegurar-se el cobrament del preu.<\/p>\n<p>En cas d&#8217;incompliment de pagament del preu o d&#8217;algun dels seus terminis, per part de la part compradora, t\u00e9 lloc la resoluci\u00f3 de la compravenda, amb la conseg\u00fcent recuperaci\u00f3 per part del venedor de l&#8217;immoble que hagu\u00e9s transm\u00e8s.<\/p>\n<p>La recent entrada en vigor del Llibre VI del Codi Civil de Catalunya ha introdu\u00eft una reforma en la regulaci\u00f3 del pacte de condici\u00f3 resolut\u00f2ria incl\u00f2s en el contracte de compravenda.<\/p>\n<p>Les novetats introdu\u00efdes s\u00f3n les seg\u00fcents:<\/p>\n<ul>\n<li>El venedor, en cas d&#8217;impagament del comprador, podr\u00e0 resoldre el contracte i recuperar l&#8217;immoble sempre que de forma pr\u00e8via a la resoluci\u00f3 efectu\u00ef un requisit notarial al comprador, concedint-li un termini m\u00e0xim de 20 dies per pagar i advertint-lo que en cas de no fer-ho tindr\u00e0 lloc la resoluci\u00f3 de la compravenda.<\/li>\n<li>Les compravendes amb pactes de condici\u00f3 resolut\u00f2ria es poden inscriure al Registre de la Propietat. En aquests casos, el pacte ha de preveure expressament que perqu\u00e8 procedeixi la resoluci\u00f3 contractual, la part impagada, inclosos els interessos, haur\u00e0 de ser superior al 15% del preu \u00edntegre de la compravenda, m\u00e9s els interessos corresponents.<\/li>\n<\/ul>\n<p>La finalitat d&#8217;aquesta previsi\u00f3 \u00e9s impedir que es pugui procedir a la resoluci\u00f3 de la compravenda per l&#8217;impagament de petites quantitats amb relaci\u00f3 al preu total de venda.<\/p>\n<ul>\n<li>Tamb\u00e9 per evitar situacions d&#8217;ab\u00fas, s&#8217;estableix que en cas d&#8217;impagament, la part venedora no podr\u00e0 fer seves m\u00e9s del 50% de les quantitats que s&#8217;haguessin devengat fins al moment en qu\u00e8 s&#8217;insta la resoluci\u00f3.<\/li>\n<li>La llei fixa uns interessos m\u00e0xims en cas d&#8217;ajornament de pagament amb condici\u00f3 resolut\u00f2ria, establint el l\u00edmit en l&#8217;inter\u00e8s legal dels diners vigent en el moment d&#8217;atorgar l&#8217;escriptura p\u00fablica, incrementat en el 50%.<\/li>\n<\/ul>\n<p>L&#8217;inter\u00e8s ha de ser fix i s&#8217;ha d&#8217;incorporar a l&#8217;escriptura un quadre d&#8217;amortitzaci\u00f3.<\/p>\n<ul>\n<li style=\"font-weight: 400;\">En cas que el comprador deixi de pagar les quantitats ajornades, el procediment que ha de seguir el venedor per fer efectiva la resoluci\u00f3 del contracte i recuperar el b\u00e9 immoble (posar-lo de nou al seu nom en el Registre de la Propietat) es tramitar\u00e0 notarialment: el notari notificar\u00e0 al comprador (en cas d&#8217;habitatge familiar tamb\u00e9 al seu c\u00f2njuge) la voluntat del venedor de resoldre el contracte. Aquest \u00faltim en el termini de 15 dies, pot pagar el deute o oposar-se a la resoluci\u00f3 per les causes que s&#8217;hagin establert en el contracte.<\/li>\n<li style=\"font-weight: 400;\">En cas d&#8217;oposici\u00f3 del comprador, caldr\u00e0 acudir als tribunals. Si no hi ha oposici\u00f3 a la resoluci\u00f3, l&#8217;acta notarial ser\u00e0 suficient per tornar a inscriure el domini a favor del venedor.<\/li>\n<li style=\"font-weight: 400;\">Aix\u00f2 no obstant, la finca quedar\u00e0 afecta al pagament de les quantitats que el venedor, com hem mencionat anteriorment, hagi de retornar al comprador.<\/li>\n<li style=\"font-weight: 400;\">Es pot pactar que els pagaments ajornats es facin al compte del notari.<\/li>\n<\/ul>\n<p>\u00c9s important destacar que el mer ajornament del pagament no est\u00e0 subjecte a condici\u00f3 resolut\u00f2ria, d&#8217;aqu\u00ed la import\u00e0ncia de la seva previsi\u00f3 expressa i la seva inclusi\u00f3 a l&#8217;escriptura per posteriorment ser inscrita al Registre de la Propietat; la qual cosa suposar\u00e0 una c\u00e0rrega sobre el b\u00e9 immoble adquirit per la referida compravenda i que la mateixa tingui efectes davant de qualsevol tercer que posteriorment pugui adquirir el mateix. Aix\u00ed, el venedor queda protegit davant de possibles transmissions del b\u00e9 immoble efectuades pel comprador, aix\u00ed com de la constituci\u00f3 de qualsevol gravamen o dret sobre el mateix.<\/p>\n<p>La compravenda d&#8217;un b\u00e9 immoble amb pagament ajornat pot ser una soluci\u00f3 en cas que el comprador no pugui obtenir finan\u00e7ament en el moment de formalitzar la compravenda, si b\u00e9, \u00e9s molt important que el venedor disposi de totes les garanties jur\u00eddiques per assegurar-se del compliment de l&#8217;obligaci\u00f3 de pagament per part del comprador, per la qual cosa \u00e9s recomanable assessorar-se degudament per a la redacci\u00f3 del pacte que tractem en aquest article.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>La condici\u00f3 resolut\u00f2ria \u00e9s una garantia de pagament quan en la compravenda s&#8217;acorda que el preu es pagar\u00e0 de forma ajornada i el venedor el que pret\u00e9n \u00e9s assegurar-se el cobrament del preu.
