Per exemple, el cas habitual de c\u00f2njuges que adquireixen un habitatge per la meitat i proindiv\u00eds.<\/p>\n<p>Aquesta situaci\u00f3 de &#8220;proindiv\u00eds&#8221; pot ser origen de problemes i conflictes quan els copropietaris no volen trobar-se en aquesta situaci\u00f3, per exemple, uns germans que hereten la habitatge dels seus pares, passant a ser copropietaris de la mateixa, i no tots els hereus tenen la mateixa disponibilitat per assumir les despeses de l&#8217;immoble, o hi ha diferents opinions sobre si procedir a l&#8217;arrendament o venda de la propietat.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Divisio_de_la_cosa_comuna\"><\/span>Divisi\u00f3 de la cosa comuna<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Cap dels comuners o copropietaris no est\u00e0 obligat a continuar en la comunitat. Qualsevol d&#8217;ells i en el moment que estimi oport\u00fa pot sol\u00b7licitar la divisi\u00f3 de la cosa comuna, llevat que aquesta provoqui la inutilitat del b\u00e9 per a l&#8217;\u00fas al qual est\u00e0 destinat.<\/p>\n<p>L&#8217;acci\u00f3 de divisi\u00f3 de la cosa comuna \u00e9s un dret reconegut a cadascun dels copropietaris i implica l&#8217;extinci\u00f3 de la comunitat. Tot i aix\u00f2, els copropietaris poden acordar mantenir la indivisi\u00f3 del b\u00e9 per un per\u00edode m\u00e0xim de 10 anys.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Procediment_per_a_la_divisio_de_la_propietat_comuna\"><\/span>Procediment per a la divisi\u00f3 de la propietat comuna<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>Amb la divisi\u00f3 de la cosa comuna, cada un dels propietaris passar\u00e0 a convertir-se en propietari exclusiu de la porci\u00f3 que li correspon del b\u00e9. Quan el b\u00e9 \u00e9s divisible es procedeix a adjudicar una part del mateix a cada copropietari. Ara b\u00e9, el m\u00e9s habitual, com \u00e9s el cas de les vivendes, \u00e9s que es tracti de b\u00e9ns indivisibles.<\/p>\n<p>En aquest cas hi ha diferents solucions: (a) el b\u00e9 s&#8217;adjudica a un dels comuners i aquest paga als altres el preu corresponent a la quota que tenia cada condueix en la comunitat; (b) vendre la cosa i repartir la quantitat obtinguda entre tots, tamb\u00e9 en funci\u00f3 de l&#8217;aportaci\u00f3 de cadascun.<\/p>\n<p>&nbsp;<\/p>\n<h4><span class=\"ez-toc-section\" id=\"Maneres_de_dividir_la_propietat_comuna\"><\/span>Maneres de dividir la propietat comuna<span class=\"ez-toc-section-end\"><\/span><\/h4>\n<p>La divisi\u00f3 de la propietat es pot efectuar de diverses maneres, mitjan\u00e7ant procediments de divisi\u00f3 que s\u00f3n tres: arribar a un acord entre les parts, mitjan\u00e7ant la intervenci\u00f3 d&#8217;\u00e0rbitres i, en \u00faltima inst\u00e0ncia, la via judicial. Si el b\u00e9 \u00e9s un immoble susceptible de constituir-se en r\u00e8gim de propietat horitzontal, \u00e9s recomanable optar per aquesta via.<\/p>\n<p>&nbsp;<\/p>\n<h5><span class=\"ez-toc-section\" id=\"Divisio_de_la_propietat_comuna_per_acord_de_les_parts\"><\/span>Divisi\u00f3 de la propietat comuna per acord de les parts.<span class=\"ez-toc-section-end\"><\/span><\/h5>\n<p>Per acord de les parts, per exemple, els hereus per unanimitat acorden de quina manera es repartiran els b\u00e9ns heretats.<\/p>\n<h5><span class=\"ez-toc-section\" id=\"Divisio_amb_la_intervencio_darbitres\"><\/span>Divisi\u00f3 amb la intervenci\u00f3 d&#8217;\u00e0rbitres.<span class=\"ez-toc-section-end\"><\/span><\/h5>\n<p>Mitjan\u00e7ant \u00e0rbitres designats de com\u00fa acord pels copropietaris, que haur\u00e0 de dividir el b\u00e9 en parts proporcionals al dret de cadasc\u00fa i finalment.<\/p>\n<h5><span class=\"ez-toc-section\" id=\"Divisio_de_la_propietat_comuna_mitjancant_la_via_judicial\"><\/span>Divisi\u00f3 de la propietat comuna mitjan\u00e7ant la via judicial.<span class=\"ez-toc-section-end\"><\/span><\/h5>\n<p>O b\u00e9 mitjan\u00e7ant la via judicial o interposici\u00f3 d&#8217;una demanda d&#8217;acci\u00f3 de divisi\u00f3 de cosa comuna quan no ha estat possible arribar a cap acord. El proc\u00e9s judicial pot concloure amb la venda de la cosa en p\u00fablica subhasta.<\/p>\n<p>La divisi\u00f3 de la cosa comuna no pot afectar els drets de tercers. Qualsevol que ostenti un dret real (hipoteca, servitud&#8230;) sobre el b\u00e9 abans de la partici\u00f3, el conservar\u00e0 despr\u00e9s d&#8217;aquesta \u00faltima. El mateix ocorre amb els drets personals.<\/p>\n<p>El Codi Civil de Catalunya regula en termes semblants al CC espanyol la divisi\u00f3 de la cosa comuna. Igualment, estableix que els copropietaris poden exigir, en qualsevol moment, la divisi\u00f3 del b\u00e9. I tamb\u00e9 es recull la possibilitat de pactar la conservaci\u00f3 indivisa de la cosa durant un per\u00edode de fins a deu anys.<\/p>\n<p>Una altra de les opcions que es contempla \u00e9s l&#8217;adjudicaci\u00f3 del dret d&#8217;usufructuar sobre la cosa a un o diversos participants i de la nua propietat a la resta de copropietaris. D&#8217;altra banda, els cotitulars amb almenys quatre quintes parts de les quotes de la comunitat poden exigir l&#8217;adjudicaci\u00f3 del b\u00e9, pagant el valor pericial de la participaci\u00f3 de la resta.<\/p>\n<p>Quan el b\u00e9 \u00e9s indivisible, l&#8217;adjudicaci\u00f3 es concedeix al condueix que posi inter\u00e8s en el mateix. Si existeix m\u00e9s d&#8217;un, a qui tingui la participaci\u00f3 major.
