L&#8217;embargament preventiu s&#8217;acorda per garantir el compliment d&#8217;una sent\u00e8ncia futura, en cas que no es pagui la quantitat a la qual es condemna o es retrassi el compliment de l&#8217;obligaci\u00f3. Si l&#8217;objecte de l&#8217;embargament \u00e9s un b\u00e9 immoble, es practica una inscripci\u00f3 (denominada anotaci\u00f3) per mandat judicial al Registre de la Propietat.<\/p>\n<p>De moment el deutor no perd el b\u00e9, per\u00f2 s\u00ed que es limita la possibilitat de transmissi\u00f3, ja que el comprador adquiriria l&#8217;immoble amb una c\u00e0rrega que el grava, l&#8217;embargament, el que resulta altament desaconsellable.<\/p>\n<p>L&#8217;embargament dictat en execuci\u00f3 de sent\u00e8ncia ferma s\u00ed que suposa la p\u00e8rdua del b\u00e9, ja que el jutjat pot acordar la subhasta del mateix per pagar el deute.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Com_es_pot_cancellar_una_anotacio_preventiva_dembargament\"><\/span>Com es pot cancel\u00b7lar una anotaci\u00f3 preventiva d&#8217;embargament?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>En primer lloc, amb el pagament: l&#8217;embargament preventiu es pot aixecar si el deutor satisf\u00e0 completament el deute.<\/p>\n<p>Les anotacions preventives d&#8217;embargament al Registre de la Propietat tamb\u00e9 poden caducar per transcurs del temps, si l&#8217;acreedor no sol\u00b7licita durant un per\u00edode determinat de temps la seva pr\u00f2rroga o renovaci\u00f3.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Quan_caduca_una_anotacio_preventiva_dembargament_al_Registre_de_la_Propietat\"><\/span>Quan caduca una anotaci\u00f3 preventiva d&#8217;embargament al Registre de la Propietat?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>Les anotacions preventives judicials d&#8217;embargament practicades amb posterioritat al 8 de gener de 2001 (data de l&#8217;entrada en vigor de la Llei 1\/2000 d&#8217;Enjudiciament Civil) caduquen al cap de quatre anys des de la data de l&#8217;anotaci\u00f3, llevat que es sol\u00b7liciti la seva pr\u00f2rroga per un per\u00edode de quatre anys m\u00e9s abans de la caducitat de l&#8217;assentament. I aix\u00ed podran practicar-se successives pr\u00f2rrogues en els mateixos termes.<\/p>\n<p>Les anotacions d&#8217;embargament practicades amb anterioritat al 8 de gener de 2001, es regeixen per la llei anterior, que permetia prorrogar-les indefinidament, per la qual cosa no cap a la seva cancel\u00b7laci\u00f3 per caducitat.<\/p>\n<p>En aquest \u00faltim cas per sol\u00b7licitar-ne la cancel\u00b7laci\u00f3, haur\u00e0 d&#8217;acreditar-se mitjan\u00e7ant testimoni de la resoluci\u00f3 judicial ferma, que el proc\u00e9s judicial ha concl\u00f2s o s&#8217;aporti el corresponent manament judicial ordenant la cancel\u00b7laci\u00f3 de l&#8217;anotaci\u00f3 d&#8217;embargament.<\/p>\n<p>Adquirir una habitatge amb una anotaci\u00f3 d&#8217;embargament suposa adquirir l&#8217;immoble amb una C\u00c0RREGA i mentre aquest deute no es liquid\u00ed, l&#8217;immoble pot ser objecte d&#8217;execuci\u00f3, per la qual cosa abans de procedir a l&#8217;adquisici\u00f3 cal consultar amb un professional les possibilitats de cancel\u00b7laci\u00f3 d&#8217;aquesta c\u00e0rrega.<\/p>\n<div id=\"gtx-trans\" style=\"position: absolute; left: 465px; top: 530.531px;\">\n<div class=\"gtx-trans-icon\"><\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Anotaci\u00f3 d&#8217;embargament: Qu\u00e8 \u00e9s?
