Si el contracte no es celebra davant d&#8217;un notari per donar-li la forma d&#8217;escriptura p\u00fablica, estarem davant d&#8217;un contracte privat.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Validesa_dun_contracte_privat_per_a_la_compravenda_dun_immoble\"><\/span>Validesa d&#8217;un contracte privat per a la compravenda d&#8217;un immoble.<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>El contracte privat de compravenda d&#8217;un immoble \u00e9s totalment v\u00e0lid a efectes legals, segons disposa l&#8217;article 1278 del Codi Civil: &#8220;els contractes seran obligatoris, qualsevol que sigui la forma en qu\u00e8 s&#8217;hagin celebrat, sempre que en ells concorrin les condicions essencials per a la seva validesa&#8221;. Aix\u00f2 no obstant, no compta amb les mateixes garanties jur\u00eddiques per a les parts.<\/p>\n<p>Per exemple, si l&#8217;anterior propietari d&#8217;un habitatge va acumular deutes, i l&#8217;immoble segueix apareixent al seu nom en el Registre de la Propietat, hi ha la possibilitat que aquell sigui embargat per liquidar els deutes.<\/p>\n<p>Amb un contracte privat, el nou propietari podr\u00e0 demostrar la seva titularitat, per\u00f2 haur\u00e0 de passar per un proc\u00e9s judicial m\u00e9s llarg i tedi\u00f3s. Aix\u00f2 significa que el contracte no es pot inscriure i que la propietat no constar\u00e0 inscrita al nom del nou propietari, amb la inseguretat jur\u00eddica que aix\u00f2 comporta.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Contractes_de_compravenda_publics\"><\/span>Contractes de compravenda p\u00fablics<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>En el cas d&#8217;un contracte p\u00fablic, a m\u00e9s de signar ambdues parts, tamb\u00e9 constar\u00e0 en el document la signatura del notari. Per\u00f2 aquesta vegada, la rubrica nom\u00e9s constar\u00e0 en l&#8217;\u00faltima fulla, i la c\u00f2pia original queda en poder de la Notaria.<\/p>\n<p>La c\u00f2pia aut\u00e8ntica \u00e9s entregada al comprador un cop liquidats els impostos i inscrita en el Registre de la Propietat. Al venedor se li sol entregar una c\u00f2pia simple del contracte.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Lliurament_de_possessio_de_limmoble\"><\/span>Lliurament de possessi\u00f3 de l&#8217;immoble<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Encara que un contracte privat de compravenda d&#8217;un immoble t\u00e9 plena validesa, perqu\u00e8 el comprador pugui considerar-se com a nou propietari, s&#8217;ha de produir el lliurament de la possessi\u00f3 d&#8217;aquest.<\/p>\n<p>Per aix\u00f2, en el contracte privat \u00e9s necessari que s&#8217;especifiqui la data de lliurament de la possessi\u00f3.
